Foreigners Moving to Kenya to Resettle or Retire

Introduction

Non-Kenyan citizens often give mixed reactions when asked about their experiences of moving into the country. One thing for sure is that local Kenyans are hospitable and tolerable. The ever-rising number of foreigners is proof enough that Kenya is a favourite destination not only for investors but also for foreigners who would wish to settle and permanently reside in the country. In this article we provide an insight on foreigners retiring and residing in Kenya.

Permit

To begin with, foreigners wishing to retire in Kenya will require Class K residence permit. This is a permit issued to persons who have an assured income derived from sources outside Kenya and undertakes not to accept paid employment of any kind. To be issued with this permit the applicant must produce documentary proof of assured income and pay both processing and government fee.

Accommodation

Ones you have the permit you will also require to consider an accommodation plan. Most retirees prefer purchasing a home for convenience. This plan is viable if you want your children or kin to inherit the property after you. The Constitution of Kenya guarantees the right to property to every person. This means that not only local citizens can own property but also foreign nationals. Purchasing or leasing a home in Kenya is generally governed by the Land Act, Land Registration Act and in case of apartments the Sectional Properties Act.

Citizenship

Upon a peaceful and lawful residence in Kenya for at least seven years, you can now apply for Kenyan citizenship. The Constitution of Kenya guarantees the right of citizenship by registration to every eligible foreign applicant. It provides that any person married to a citizen for a period of at least seven years or any person who has lawfully been resident in Kenya for at least seven years or any child adopted by a citizen, on application is entitled to be registered as a citizen. Additionally, registration of foreign nationals is governed by the Kenya Citizenship and Immigration Act of 2011 which requires all foreign nationals resident in Kenya for a period exceeding 90 days to be registered.
