Requirements for Registering a Recruitment Agency

Eligibility points for Registration of a Private Employment Agency: 

The Director of Employment may Register an Employment Agency if: 

  1. The Agency is registered as a limited liability company under the Companies Act. 
  2. At least one shareholder is a Kenyan citizen. 
  3. The Directors have an O-level certificate or its equivalent. 
  4. The Manager has at least one degree in a business related field from a university recognized in Kenya and has relevant experience of at least 3 years. 
  5. It has a minimum share capital of Ksh. 5,000,000.
  6. It has a business license. 
  7. It has a registered office that is fully equipped and is not less than 225 square feet. 
  8. It has a tax compliance certificate from KRA. 
  9. It has duly executed form ML/NEB/FE/SB/1 (security bond form) and an executed guarantee of ksh. 1,500,000 with a bank or insurance agent in Kenya. 
  10. All the Directors have a valid police clearance certificate. 
  11. It is a member of an association of private employment agencies recognized by the Director of Employment. 
  12. It commits to observe the provision of the existing code of conduct. 

Application requirements: 

  1. An application for registration is made to the director together with:
    a) A duly executed prescribed application form;
    b) A certified copy of the certificate of incorporation;
    c) Certified copies of academic and professional certificates of Managers and Directors; 
    d) A copy of the operating license by the relevant county authority; 
    e) A valid lease or tenancy agreement authenticated by a Commissioner for Oaths; 
    f) Copies of identity cards or passports for all Directors. And if a director is a foreigner, a valid work permit; 
    g) Two recent passport size photographs of the Directors;
    h) A good conduct certificate from the police for the applicant and the Directors;
    i) A tax compliance certificate of the Directors and the company; and 
    j) The PIN certificate of the Company and the Directors.  

Registration process:

Login on the National Employment Agency portal and sign up. 

Once signed up login to the account and enter in the required details of the Agency and its Directors. Then, upload all documents mentioned above in the required format.   

The director of employment will then send an employment officer to visit the premises and conduct an inspection. A report is drawn that covers the staffing, the premises, office facilities and licenses. If the Director of Employment is satisfied with the report, he will grant a certificate of accreditation/license, upon payment of fees. 

Fees: 

An initial application for registration of an agency dealing with recruitment for the local labor market – ksh. 125,000

An initial application for the registration of an agent dealing with recruitment for foreign labor market – ksh. 500,000.
